1. Introduction & Acceptance

These Terms of Service (“Terms”) govern your use of The Masthead mobile application and website (the “Service”), operated by Dmytro Bohdanov, sole proprietor (Jednoosobowa Działalność Gospodarcza), NIP: 8992981145, registered in Poland (“we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

The Masthead is an AI-powered news curation application. The Service aggregates publicly available RSS feeds from over 400 news sources worldwide and uses artificial intelligence to curate, summarize, translate, and present news content in your language.

Features include personalized news feeds, AI-generated daily digests, text-to-speech narration, AI video podcasts, multilingual translation, and AI-powered news discussion.

3. AI-Generated Content

The Masthead uses artificial intelligence to generate original summaries, translations, and analyses inspired by topics found in publicly available RSS feeds. We do not copy, reproduce, or redistribute original articles. All AI-generated content is original work created by our systems.

Links to original source articles are provided for reference and attribution. We encourage users to visit original sources for the most authoritative and complete reporting.

Accuracy Disclaimer: AI-generated content may contain inaccuracies, errors, or misrepresentations. The Masthead does not guarantee the accuracy, completeness, or timeliness of AI-generated summaries. You should not rely solely on AI-generated content for critical decisions. Always refer to the original source articles for authoritative information.

All AI-generated content is clearly identified as such within the Service.

4. Subscriptions & Payments

4.1 Free Tier

The Service offers a free tier with access to your personalized feed, daily digest, limited translations, basic audio, and limited AI discussions.

4.2 Premium Subscription

The Premium subscription ($12.99 USD per month) unlocks unlimited translations, unlimited deep dive articles, premium AI voice narration, listening to your My Feed, background listening, unlimited AI discussions, up to 5 reading languages, AI podcast summaries with subtitles, and unlimited feed and podcast subscriptions.

4.3 Billing & Auto-Renewal

Payment will be charged to your Apple ID account (App Store) or Google Play account at confirmation of purchase. Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the subscription price.

4.4 Cancellation

You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing period.

4.5 Refunds

Refund requests are handled by the Apple App Store or Google Play Store in accordance with their respective refund policies.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You may not share your account with others or create multiple accounts. You may delete your account at any time through the app settings, which will permanently remove all your personal data.

6. Acceptable Use

You agree not to:

• Scrape, crawl, or use automated means to access the Service beyond the intended user interface.
• Reproduce, redistribute, or commercially exploit content from the Service without prior written consent.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Attempt to gain unauthorized access to the Service, other user accounts, or related systems.
• Use the Service for any unlawful purpose or in violation of these Terms.

Zero tolerance for objectionable content and abusive behavior. You agree not to submit, generate, or solicit content — including via the in-app AI discussion feature — that is unlawful, hateful, harassing, threatening, defamatory, obscene, sexually explicit, or otherwise objectionable, and not to harass or abuse other users or our staff. We have no tolerance for objectionable content or abusive users.

Reporting and enforcement. You can report objectionable content directly in the app — including any individual AI-generated reply (via the report control on each reply) and any aggregated article (via the report option in the article menu) — or by emailing support@themasthead.app. We review every report and act on objectionable content and abusive users — by removing content and/or suspending or terminating accounts — within 24 hours.

7. Intellectual Property

The Masthead application, including its design, code, AI models, and branding, is the intellectual property of Dmytro Bohdanov. AI-generated summaries, translations, and analyses are original derivative works created by our systems and are our intellectual property.

Original articles linked from the Service remain the intellectual property of their respective publishers.

8. Publisher Opt-Out

We respect the intellectual property rights of news publishers. The Masthead aggregates content exclusively from publicly available RSS feeds — a distribution format specifically designed for syndication and aggregation.

If you are a publisher and wish to have your RSS feed removed from our index, please contact us at privacy@themasthead.app. We will process your request within 5 business days.

9. Copyright & DMCA

If you believe that content available through the Service infringes your copyright, please send a notice to privacy@themasthead.app with the following information:

• Identification of the copyrighted work you believe is infringed.
• Identification of the content on The Masthead that you believe is infringing, with sufficient detail for us to locate it.
• Your contact information (name, email, mailing address).
• A statement that you have a good faith belief that the use is not authorized.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

We will investigate and respond to valid copyright notices promptly.

10. Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages resulting from reliance on AI-generated content.

Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Poland.

If you are a consumer in the European Union, you also have the right to bring proceedings in the courts of your country of residence, and nothing in these Terms affects your statutory consumer rights under EU law.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and, where appropriate, through in-app notification or email. Continued use of the Service after changes constitutes acceptance of the revised Terms.
